§ 1

Preliminary provisions

§ 2

Definitions

2. Sprzedawca – Spółka: ZIELONI HANDLOWCY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ NIP 5223243877 KRS 0001007583 REGON 523906394 SĄD REJONOWY DLA M.ST. WARSZAWY W WARSZAWIE, XIV WYDZIAŁ GOSPODARCZY KRAJOWEGO REJESTRU SĄDOWEGO, wpis do rejestru: 2022-12-12 r. ZAREJESTROWANYM POD ADRESEM Czereśniowa 13B, 02-457, Warszawa, POLSKA

  1. Klient – każdy podmiot dokonujący zakupów za pośrednictwem Sklepu.

  2. Przedsiębiorca – Przedsiębiorca – osoba fizyczna, osoba prawna lub jednostka nieposiadająca osobowości prawnej, dokonująca czynności prawnej we własnym imieniu w ramach działalności gospodarczej lub zawodowej, w tym dokonująca zakupów w Sklepie w celu związanym bezpośrednio ze swoją działalnością gospodarczą, gdy korzystanie ze Sklepu w tym dokonywanie zakupów w Sklepie stanowi dla tej osoby charakter zawodowy, wynikający w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej, udostępniony na podstawie przepisów o Centralnej Ewidencji Informacji o Działalności Gospodarczej.

  3. Store – sklep internetowy prowadzony przez Sprzedawcę pod adresem internetowym konopnybuch.pl

  4. Umowa zawarta na odległość – umowa zawarta z Klientem w ramach zorganizowanego systemu zawierania umów na odległość (w ramach Sklepu), bez jednoczesnej fizycznej obecności stron, z wyłącznym wykorzystaniem jednego lub większej liczby środków porozumiewania się na odległość do chwili zawarcia umowy włącznie.

  5. Regulations – niniejszy regulamin Sklepu.

  6. Order – oświadczenie woli Klienta składane za pomocą Formularza Zamówienia i zmierzające bezpośrednio do zawarcia Umowy Sprzedaży Produktu lub Produktów ze Sprzedawcą.

  7. Konto – konto klienta w Sklepie, są w nim gromadzone są dane podane przez Klienta oraz informacje o złożonych przez niego Zamówieniach w Sklepie.

  8. Formularz rejestracji – formularz dostępny w Sklepie, umożliwiający utworzenie Konta.

  9. Formularz zamówienia – interaktywny formularz dostępny w Sklepie umożliwiający złożenie Zamówienia, w szczególności poprzez dodanie Produktów do Koszyka oraz określenie warunków Umowy Sprzedaży, w tym sposobu dostawy i płatności.

  10. Basket – element oprogramowania Sklepu, w którym widoczne są wybrane przez Klienta Produkty do zakupu, a także istnieje możliwość ustalenia i modyfikacji danych Zamówienia, w szczególności ilości produktów.

  11. Product – dostępna w Sklepie rzecz ruchoma/usługa będąca przedmiotem Umowy Sprzedaży między Klientem a Sprzedawcą.

  12. Umowa Sprzedaży – umowa sprzedaży Produktu zawierana albo zawarta między Klientem a Sprzedawcą za pośrednictwem Sklepu internetowego. Przez Umowę Sprzedaży rozumie się też – stosowanie do cech Produktu – umowę o świadczenie usług i umowę o dzieło.

§ 3

  2. The Customer may communicate with the Seller using the addresses and telephone numbers specified in this paragraph.

  3. The customer can communicate with the Seller by phone between 9 am and 5 pm.

§ 4

Technical requirements

In order to use the Store, including browsing the Store's assortment and placing orders for Products, it is necessary:

  1. A terminal device with Internet access and a chrome web browser,

  2. active electronic mail (e-mail) account,

  3. cookies enabled,,

  4. FlashPlayer installed.

§ 5

General information

  1. To the fullest extent permitted by law, the Seller shall not be liable for any disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized acts of third parties or incompatibility of the Online Store with the technical infrastructure of the Customer.

  2. Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Terms and Conditions or by providing the necessary personal and address data to allow the Order to be processed without creating an Account.

  1. The prices given in the Store are given in Polish zloty and are gross prices (including VAT).

§ 6

Creating an Account in the Store

  1. In order to create an Account in the Store, you need to complete the Registration Form. It is necessary to provide the following data first name, last name, address, telephone number, e-mail address.

  2. Creating an Account in the Store is free of charge.

  3. Logging into the Account is done by entering the login and password established in the Registration Form.

  4. The Customer has the opportunity to delete the Account at any time, without giving any reason and without paying any fees for it, by sending an appropriate request to the Seller, in particular by e-mail or in writing to the addresses specified in § 3.

§ 7

Rules for placing an Order

In order to place an Order, you must:

  1. Log in to the Store (optional);

  2. select the Product that is the subject of the Order, and then click the "Add to cart" button (or equivalent);

  3. Log in or use the option to place an Order without registration;

  4. if you have chosen the option of placing an Order without registration - fill out the Order Form by entering the data of the recipient of the Order and the address to which the Product is to be delivered, select the type of shipment (method of delivery of the Product), enter the data for the invoice, if different from the data of the recipient of the Order,

  5. click the "Order and pay"/click the "Order and pay" button and confirm the order by clicking on the link sent in the email,

  6. select one of the available payment methods and, depending on the payment method, pay for the order within the specified period of time, subject to § 8.3.

§ 8

Delivery and payment methods offered

  1. The customer can use the following methods of delivery or pickup of the ordered Product:

  1. Postal delivery, cash on delivery,

  2. Inpost shipping, cash on delivery

  3. Courier delivery, cash on delivery,

  4. Personal collection available at the address: indicated above,

  1. The customer can use the following payment methods:

  1. Payment on delivery

  2. Cash on delivery

  3. Payment by bank transfer to the Seller's account

  4. Electronic payments

  5. Payment by credit card.

(3) Detailed information on delivery methods and acceptable payment methods can be found behind the pages of the Store.

The Customer may choose the following forms of payment for the ordered Goods: BLIK payments, payment card, electronic transfer through an external payment system imoje, operated by the company ING Bank Śląski S.A. based in Katowice.
                               

§ 9

Implementation of the sales contract

  1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order using the Order Form in the Online Store in accordance with § 7 of the Terms and Conditions.

  2. After the Order is placed, the Seller shall immediately confirm its receipt and simultaneously accept the Order for execution. Confirmation of receipt of the Order and its acceptance for execution is made by the Seller sending the Client an appropriate e-mail message to the Client's e-mail address provided during the placement of the Order, which contains at least the Seller's statements about receipt of the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. As soon as the Customer receives the above e-mail message, the Sales Agreement between the Customer and the Seller is concluded.

  3. If the customer chooses:

  1. payment by bank transfer, electronic payment or payment card, the Customer is obliged to make payment within .... calendar days from the date of conclusion of the Sales Agreement - otherwise the order will be cancelled.

  2. payment on delivery, the customer is obliged to make payment on delivery.

  3. payment in cash upon personal collection of the shipment, the customer is obliged to make payment upon collection of the shipment within .... days from the date of receipt of information that the shipment is ready for collection.

  1. If the Customer has chosen a method of delivery other than personal collection, the Product will be shipped by the Seller on the date indicated in its description (subject to paragraph 5 of this section), in the manner selected by the Customer when placing the Order.

  2. A If you order Products with different delivery dates, the delivery date is the longest date given.

B In case of ordering Products with different delivery times, the Customer has the option to request delivery of the Products in parts, or delivery of all the Products after the entire order is completed.

  1. The beginning of the period for delivery of the Product to the Customer is calculated as follows:

  1. If the Customer chooses the method of payment by bank transfer, electronic payment or payment card - from the date of crediting the Seller's bank account.

  2. If the Customer chooses cash on delivery payment method - from the date of conclusion of the Sales Agreement,

(6) If the Customer chooses to collect the Product in person, the Product will be ready for collection by the Customer on the date indicated in the Product description. The Customer will additionally be informed by the Seller about the readiness of the Product for collection by sending an appropriate e-mail message to the Customer's e-mail address provided during the placement of the Order.

(7) In the case of ordering Products with different dates of readiness for acceptance, the date of readiness for acceptance shall be the longest date given.

(9) Delivery of the Product shall take place only in the territory of Poland.

The Product delivery costs (including transportation, delivery and postal service fees) are indicated to the Customer on the pages of the Online Store under the "Delivery Costs" tab and during the placement of the Order, including at the moment of expressing the Customer's will to be bound by the Sales Agreement.

(11) Personal collection of the Product by the Customer is free of charge.

§ 10

Right of withdrawal

  1. The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.

  2. The running of the period specified in paragraph 1 begins with the delivery of the Product to the Consumer or a person other than the carrier designated by the Consumer.

  3. In the case of a Contract that includes multiple Products that are delivered separately, in batches or in parts, the term indicated in paragraph 1 shall run from the delivery of the last item, batch or part.

  4. In the case of a Contract that involves the regular delivery of Products for a specified period of time (subscription), the term indicated in paragraph 1 shall run from taking possession of the first item.

  5. The Consumer may withdraw from the Contract by submitting a statement of withdrawal from the Contract to the Seller. To meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send the statement before the deadline.

  1. The statement can be sent by traditional mail, fax or electronically by sending the statement to the Seller's e-mail address or by submitting a statement on the Seller's website - the Seller's contact details are specified in § 3. The statement can also be submitted on the form, the template of which is attached as Appendix No. 1 to these Regulations and Appendix to the Act of May 30, 2014 on Consumer Rights, but it is not mandatory.

  1. If the Consumer sends a statement electronically, the Seller will immediately send the Consumer at the e-mail address provided by the Consumer a confirmation of receipt of the statement of withdrawal from the Agreement.

  2. Effects of withdrawal from the Agreement:

  1. In the case of withdrawal from the Agreement concluded remotely, the Agreement is considered not concluded.

  2. In the event of withdrawal from the Agreement, the Seller shall return to the Consumer immediately, no later than within 14 days from the date of receipt of the Consumer's statement of withdrawal from the Agreement, all payments made by the Consumer, including the costs of delivering the item, except for additional costs resulting from the delivery method chosen by the Consumer other than the cheapest ordinary delivery method offered by the Seller.

  3. The Seller will refund the payment using the same methods of payment that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution that will not incur any costs for him.

  4. The seller may withhold reimbursement until it receives the Product back or until it is provided with proof of return, whichever event occurs first.

  5. The Consumer should send back the Product to the Seller's address given in these Terms and Conditions immediately, no later than 14 days from the day on which he informed the Seller about the withdrawal from the Contract. The deadline will be met if the Consumer sends back the Product before the expiration of the 14-day period.

  6. The Consumer shall bear the direct costs of returning the Product, including the costs of returning the Product if, due to its nature, the Product could not be returned by mail in the usual manner.

  7. The consumer shall be liable only for the diminution in value of the Product resulting from the use of the Product in a manner other than necessary to ascertain the nature, characteristics and functioning of the Product.

(9) In the event that, due to the nature of the Product, it cannot be returned by ordinary mail, information about this, as well as about the cost of returning the Product, will be located in the description of the Product in the Store.

(10) The right of withdrawal from a contract concluded at a distance shall not be granted to the Consumer with respect to the Contract:

  1. in which the object of performance is a non-refabricated item, manufactured to the Consumer's specifications or serving to meet his individualized needs,

  2. in which the object of the service is an item delivered in a sealed package, which cannot be returned after opening the package for health or hygiene reasons, if the package has been opened after delivery,

  3. in which the object of performance is an item that is perishable or has a short shelf life,

  4. for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the start of the service, that after the performance of the Seller will lose the right to withdraw from the Agreement,

  5. in which the price or remuneration depends on fluctuations in the financial market, over which the Seller has no control, and which may occur before the expiration of the deadline for withdrawal from the Contract,

  6. in which the object of performance is things that, after delivery, due to their nature, become inseparable from other things,

  7. in which the subject of performance is alcoholic beverages, the price of which was agreed upon at the conclusion of the contract of sale, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the Seller has no control,

  8. in which the subject of performance is sound or visual recordings or computer programs delivered in sealed packaging, if the packaging was opened after delivery,

  9. for the supply of daily newspapers, periodicals or magazines, except for a subscription contract,

  10. for the delivery of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the Consumer before the expiration of the deadline for withdrawal from the contract and after the Seller has informed him of the loss of the right to withdraw from the contract, 

    The entitlement referred to above also applies to an individual who enters into a contract directly related to his business activity, when it is apparent from the content of the contract that it does not have a professional character for that person, arising in particular from the subject of his business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

§ 10.1 Warranty for Entrepreneurs

 

1.

The Seller shall ensure Delivery of Goods free of defects. The Seller shall be liable to the Entrepreneur if the Goods have a defect.

 

2.

If the Goods have a defect, the Entrepreneur may:

 

a)

make a statement about reducing the price or withdrawing from the Sales Contract, unless the Seller immediately and without excessive inconvenience for the Entrepreneur replaces the defective Goods with defect-free ones or removes the defect.

 

This limitation does not apply if the Goods have already been replaced or repaired by the Seller or the Seller has failed to comply with the obligation to replace the Goods with defect-free Goods or remove defects. The Entrepreneur may, instead of the removal of defects proposed by the Seller, demand replacement of the Goods with defect-free Goods or, instead of replacement of the Goods, demand removal of defects, unless bringing the Goods into conformity with the agreement in the manner selected by the Entrepreneur is impossible or would require excessive costs in comparison with the manner proposed by the Seller. When assessing the excessiveness of costs, the value of the Goods free from defects, the type and significance of the defect found shall be taken into account, as well as the inconvenience to which the Entrepreneur would be exposed by another way of satisfaction.

 

b)

demand to replace the Defective Goods with defect-free or remove the defect. The Seller shall replace the Defective Goods with defect-free Goods or remove the defect within a reasonable time without undue inconvenience to the Entrepreneur.

 

The Seller may refuse to satisfy the request of the Entrepreneur if bringing the defective Goods into conformity with the Contract of Sale in the manner chosen by the Entrepreneur is impossible or in comparison with the other possible way of bringing them into conformity with the Contract of Sale would require excessive costs. The cost of repair or replacement shall be borne by the Seller.

 

3.

An entrepreneur who exercises warranty rights is obliged to deliver the defective thing to the Seller's address. The cost of delivery shall be covered by the Seller.

 

4.

The Seller shall be liable under the warranty if a physical defect is discovered before the expiration of two years from the release of the Goods to the Entrepreneur. The claim for removal of the defect or replacement of the Goods with defect-free Goods shall become time-barred after one year, but this period cannot end before the expiration of the period specified in the first sentence. Within this period, the Entrepreneur may withdraw from the Sales Contract or make a statement of price reduction due to a defect in the Goods. If the Entrepreneur has demanded replacement of the Goods with defect-free Goods or removal of the defect, the time limit for withdrawal from the Sales Contract or submission of a statement on price reduction shall begin upon ineffective expiration of the time limit for replacement of the Goods, or removal of the defect

§ 11

Complaint and warranty

  1. The Sales Agreement covers new products. On the pages of the Store, the condition of each Product is described in detail.

  2. All goods have no defects and are unused.

  3. New products are understood to be the sale of CBD products, including dried CBD, from fiber hemp, according to the current law in Poland, where THC content does not exceed 0.2%. Each product has separate tests, access in the Certificates tab.

  1. Complaints should be submitted in writing or electronically to the Seller's addresses given in these Regulations.

(4) Complaints should be reported in writing or electronically to the Seller's addresses given in these Regulations or by using an electronic complaint form, made available by the Seller on one of the subpages of the Store.

  1. It is recommended to include in the complaint, among other things, a brief description of the defect, the circumstances (including the date) of its occurrence, the data of the customer making the complaint, and the customer's request in connection with the defect of the goods.

  1. The Seller will respond to the complaint request immediately, no later than within 14 days, and if it does not do so within this period, it is considered that the Customer's request was considered justified.

  1. Towary odsyłane w ramach procedury reklamacyjnej należy wysyłać na adres podany w § 3 niniejszego Regulaminu. Uprawnienie, o którym mowa powyżej dotyczy również osoby fizycznej zawierającej umowę bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej umowy wynika, że nie posiada ona dla tej osoby charakteru zawodowego, wynikającego w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej, udostępnionego na podstawie przepisów o Centralnej Ewidencji i Informacji o Działalności Gospodarczej.

§ 8 Complaints

 

1.

Any complaints related to the Goods or the implementation of the Sales Contract, the Entrepreneur may address in writing to the address of the Seller

The Seller shall, within 14 days from the date of the request containing the complaint, respond to the complaint of the Goods or the complaint related to the execution of the Sales Contract submitted by the Entrepreneur.

 

3.

Klient może zgłosić Sprzedawcy reklamację w związku z korzystaniem z usług nieodpłatnych świadczonych drogą elektroniczną przez Sprzedawcę. Reklamacja może być złożona w formie elektronicznej i przesłana na adres [email protected]. W zgłoszeniu reklamacyjnym Przedsiębiorca winien zawrzeć opis zaistniałego problemu. Sprzedawca niezwłocznie, lecz nie później niż w terminie 14 dni rozpatruje reklamacje i udziela Przedsiębiorcy odpowiedzi.

§ 12

Out-of-court ways of dealing with complaints and redress of grievances

  1. Detailed information on the consumer's ability to use out-of-court procedures for handling complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and websites of county (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Commercial Inspection and at the following web addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.

  2. The consumer has the following examples of out-of-court means of complaint handling and redress:

  1. The consumer shall be entitled to apply to the permanent amicable consumer court referred to in Article 37 of the Act of December 15, 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended) to resolve a dispute arising from the Agreement concluded with the Seller.

  2. The Consumer shall be entitled to apply to the provincial inspector of the Commercial Inspection, in accordance with Article 36 of the Act of December 15, 2000 on Commercial Inspection (Journal of Laws of 2014, item 148, as amended), to initiate mediation proceedings for the amicable settlement of a dispute between the Consumer and the Seller.

  3. A consumer may obtain free assistance in resolving a dispute between him and the Seller, also using the free assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection (such as the Consumer Federation, the Association of Polish Consumers).

§ 13

Personal information in the Online Store

  1. The administrator of Customers' personal data collected through the Online Store is the Seller.

  2. Customers' personal data collected by the administrator through the Online Store are collected for the purpose of executing the Sales Agreement, and if the Customer agrees - also for marketing purposes.

  3. Recipients of personal data of Customers of the Online Store may be:

  1. In the case of a Customer who uses postal or courier delivery method in the Online Store, the Administrator shall make the collected personal data of the Customer available to the selected carrier or intermediary performing shipments on behalf of the Administrator.

  2. In the case of a Customer who uses electronic or credit card payment method in the Online Store, the Administrator shall make the collected personal data of the Customer available to the selected entity handling the above payments in the Online Store.

(4) The customer has the right to access and correct the content of his data.

(5) Provision of personal data is voluntary, although failure to provide the personal data indicated in the Regulations necessary for the conclusion of the Sales Agreement results in the impossibility of concluding this agreement.

§ 14

Final provisions

(1) Contracts concluded through the Online Store are concluded in the Polish language.

(2) The Seller reserves the right to make changes to the Terms and Conditions for important reasons, that is: changes in laws, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Client about each change at least 7 days in advance.

(3) Matters not covered by these Regulations shall be governed by generally applicable provisions of Polish law, in particular: Civil Code; Act on Provision of Electronic Services; Act on Consumer Rights, Act on Personal Data Protection.

(4) The customer has the right to use out-of-court means of handling complaints and claims. For this purpose, he may file a complaint through the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/[email protected]@[email protected] Buch1
